This may be one of the most important lawsuits we’ve ever funded. Five years ago this month, the U.S. government rolled out the first COVID-19 “vaccines.” Health officials promised the unlicensed shots were “safe and effective.” Yet millions of people who took the vaccines were injured. Some of those injuries were “mild.” Some were debilitating and life-changing. Some were fatal. Even though the unlicensed, “experimental” vaccines used an unproven mRNA technology and were rushed to market without proper safety testing, vaccine makers, government planners, and anyone who administered the shots got a free pass — the government protected them from lawsuits, under a law called the “PREP Act.” But what about the injured? Who protected them? The PREP Act created a program that is supposed to compensate people injured by experimental products like the COVID vaccines used in an emergency. But that program has a catch — your injury has to be “serious” or deadly, or you can’t even apply for compensation. Under the Countermeasures Injury Compensation Program — or CICP — that the PREP Act created, the two women in this lawsuit are completely out of luck. Their injuries — POTS, Epstein-Barr, neuropathy, tachycardia, high blood pressure, to name a few — just weren’t “serious” enough for the CICP to even consider. The lawsuit we helped these women file against HRSA, the government agency that runs the compensation program, asks the court to: Declare the CICP unconstitutional under the Fifth and 14th Amendments of the U.S. Constitution. Order HRSA to make the CICP available to the plaintiffs. Stop HRSA from continuing to implement the CICP as is. Why is this lawsuit so important? Because the women who filed it represent hundreds of thousands, possibly millions, of people who either volunteered to take, or were mandated or coerced to take, a vaccine that government officials knew had serious safety issues. And now that same government is leaving them completely out in the cold, with no available remedy in any court or compensation program. We believe the government owes these two women — and everyone else who was injured by a COVID vaccine — access to justice and due compensation.
