DC Circuit unanimously denies DOGE effort to block discovery in CREW FOIA lawsuit

The DC Circuit Court of Appeals just unanimously rejected DOGE’s latest attempt to block discovery in our lawsuit under the Freedom of Information Act and the Federal Records Act.

The so-called Department of Government Efficiency was controlling major government functions with no oversight or meaningful transparency into its operations. So we sued to ensure that DOGE would provide much-needed and long-overdue information on its structure and operations.

Even though DOGE may appear to have a reduced role now compared to the start of the second Trump administration, it still exists and has had an unprecedented impact on the federal government and the civil service, including gutting crucial services Americans rely on.

In just four weeks, DOGE executed a potentially unlawful plan to dismantle the U.S. Agency for International Development and the Consumer Financial Protection Bureau, took credit for the cancellation of billions of dollars in federal contracts, secured potentially illegal access to systems containing highly restricted and confidential data and enlisted and claimed authority to summon federal law enforcement.

And it did this all in secret.

The American people have a right to know how DOGE manages their tax dollars, how it is exercising its authority to influence government operations and the extent to which it is operating outside of its slim legal mandate.

That’s why CREW filed a lawsuit demanding DOGE disclose its records under the Freedom of Information Act and preserve its records under the Federal Records Act.

John, we’ve been fighting this since February — a long and ongoing battle as DOGE has tried again and again to keep their records secret.

Every step of the way, they’ve filed motions to block our access, delaying transparency and accountability. But we’ve remained relentless, pushing back each time to make sure the American people can see the truth.

Now that the DC Circuit Court of Appeals unanimously rejected DOGE’s latest attempt to block discovery in our lawsuit, CREW is entitled to the depositions of Acting DOGE Administrator Amy Gleason and another DOGE representative, as well as documents and sworn answers to CREW’s written questions.

These materials will help show whether DOGE is an agency under FOIA or the Federal Records Act — something DOGE has denied. For now, discovery is on hold for at least 90 days so the government has time to potentially appeal to the Supreme Court.
