I'm following up on the note I sent you about CHD’s new lawsuit in New York — because the stakes couldn’t be higher.
As a reminder, we’ve asked the court for immediate relief: a temporary restraining order and preliminary injunction to restore religious exemptions for families whose children are being denied access to school.
Our lawsuit lays out how New York continues to violate parents’ deeply held religious beliefs by conditioning education on vaccination and how the state’s 2019 repeal law infringes on First Amendment freedoms and equal protection under the law.
The timing of this case is critical.
Just last week, the U.S. Supreme Court vacated a Second Circuit decision that denied religious exemptions in New York — a development that strengthens our constitutional arguments and opens the door for real change.
This is not a new fight for us. Since June 2019, when the State repealed the religious exemptions and threw more than 26,000 children out of school, CHD has stayed in this battle, strategically, persistently, and without backing down.
But legal victories don’t happen by chance. They require preparation, focus, and the resources to act when the moment is right — like now.
