I was on the third floor of the gallery inside the House, squeezed between narrow rows of seats, when I heard a growing crescendo of speech that seemed out of order.

Soon, a police officer told me and my colleagues to put on gas masks stowed under seats—that crystallized for me the danger we were in.

As Trump's rioters stormed the Capitol on January 6th, I was one of the last lawmakers to leave the chamber.

John, I tell this story because I want us all to keep in mind how precious our democracy is, how close we came to losing it, and how fragile it is today.

In February that year, the Senate acquitted Trump of inciting an insurrection… so I joined a lawsuit insisting Trump had violated the KKK Act for whipping up his supporters (and white Supremacists) to stop us from certifying the election.

Trump has fought the suit tirelessly, claiming he didn't do it—and if he did do it, it was legal.

And now the suit hangs in the balance of our federal courts, which is frightening for a few reasons:

In 2022, the federal Judge looking at the case ruled that some remarks Trump made during his speech (like telling supporters to “fight like hell”) were not done in an official capacity—it was the first in this country’s history that a court had found a president wasn’t entitled to immunity for conduct occurring while he was president.

In 2024, the MAGA Supreme Court decided that Presidents have immunity from ANY act committed in their official capacity.

That same federal Judge is examining the case now—and if he doesn't rule the way Trump wants, it's likely that the president will appeal to the same Supreme Court he installed.

John, this could be our last chance to hold Trump accountable through our broken court system, which means we must prepare to uphold our duty to protect and defend our rights and freedoms.
