In October, soldiers in fatigues showed up on American streets, again. Not because of a natural disaster. Not because of a riot or rebellion. And not because local officials requested help. Instead, the National Guard began patrolling neighborhood streets in Memphis because Tennessee Governor Bill Lee chose to do President Trump's bidding — in clear violation of state law and the Tennessee Constitution.
We sued immediately and won a court order to block the unlawful National Guard deployment to Memphis, Tennessee. This ruling makes clear that no governor or president can deploy military force into our communities without legal authority or public accountability.
Our legal arguments, filed on behalf of seven elected Memphis officials, were clear: Tennessee law only allows National Guard deployment in cases of rebellion or invasion, and only when the General Assembly declares it necessary. None of that happened. Governor Lee simply overstepped his authority in order to help the Trump administration.
And friend, this isn’t only about Memphis. President Trump has been eager to misuse wartime and emergency authorities, to militarize American cities, and to desensitize the public to the presence of soldiers in their streets. But we know that armed forces have no place patrolling the neighborhoods of a democracy.
At the National Immigration Law Center, we're not standing by and watching this unfold. We're fighting back in court and defending the constitutional principles that protect all of us — immigrants and citizens alike.
But taking on the Trump administration won’t be easy. The attacks on our communities will only intensify, and we need to be ready for anything.
