As we approach the end of the year, I wanted to share an important update from the United States Sentencing Commission.
On Friday, December 12, the Sentencing Commission voted to propose amendments for the 2026 federal sentencing guideline cycle. We are still reviewing the proposals to better understand how they may impact your loved ones if finalized, but we wanted to give you an early heads-up about the issues the Commission will be considering next year.
The proposed amendments address several significant areas, including:
- Drug offenses (methamphetamine sentencing disparities, fentanyl, and fentanyl analogues);

The economic crimes loss table;
- A potential downward adjustment for good behavior after the offense but before sentencing;
- How offense levels are calculated in cases involving multiple counts; and
-
A possible enhancement for offenses involving “sophisticated means”

Public comment on these proposals is due by February 10, 2026. Early in the new year, I will share guidance to help you weigh in on these amendments, along with more information about how FAMM plans to respond.
