LEGISLATIVE ACTION ALERT Imminent House Passage Expected We anticipate three bills to be voted on by the full Michigan House of Representatives this week. MCRGO supports all three bills. In addition, a hearing is scheduled this Wednesday to repeal Michigan's red flag law adopted last session. MCRGO supports that legislation. We urge you to send a short email to your state representative today. You can locate your state representative HERE. Sending an email in your own words will receive more attention from legislators than form letters or petitions. However, feel free to copy and paste some of the arguments below in favor of the legislation that reflects your views. CPL Renewal Fees: House Bill 4284 would reduce the fee for a concealed pistol license renewal from $115 to $30. The CPL fee functions as a financial barrier to constitutional rights. Michigan’s fees are very high compared to other states. Modernization has reduced administrative costs. Reducing the fee encourages legal, responsible carry. A reduced renewal fee would align with actual administrative costs. CPL Application Venue: House Bill 4980 would modify the current requirement to apply for a concealed pistol license in the county of one's residence. Instead, an application could be made in any Michigan county. The change would reduce administrative burdens in counties with application backlogs and longer wait times. More consistent and efficient service would result from allowing applications in any county. The change would help balance workloads across clerks' offices between higher and lower population counties. Licensing modernization reflects today's more mobile society. This legislation would reduce travel and time away from work for applicants whose place of employment is closer to another county seat than the county in which they reside. Administrative Errors Grace Period: House Bill 5113 would provide for a grace period for concealed pistol license denials due to administrative error. This legislation provides for due process and fundamental fairness by ensuring the applicants are not penalized for simple mistakes by either the applicant or the clerks' staff. The bill would allow CPL applicants whose original application was disqualified by the county clerk because of an error by the applicant to submit a new application with corrected information within 21 business days after receiving a notice of statutory disqualification. If an applicant determines that their original CPL application contains an error before receiving a notice of statutory disqualification from the county clerk, the applicant could submit an updated application within 21 business days after submitting the original application. An updated application submitted under this provision of the bill would not be subject to an additional application fee. If a county clerk issues a notice of statutory disqualification because of an error by an individual other than the applicant, the applicant could submit a new CPL application at any time without paying an additional fee, provided that the applicant submits supporting documents that correct the error. House Hearing on Red Flag Repeal Legislation to repeal Michigan’s red flag law, also known as the Extreme Risk Protection Order, or ERPO, will be taken up for testimony in the House Judiciary Committee this Wednesday, December 17, 2025. MCRGO director and law professor Steve Dulan will testify in support of the repeal on behalf of MCRGO and its members. MCRGO strongly opposed the passage of the existing law from the 2023-2024 legislative session. Michigan is the second state after Florida to introduce legislation to repeal its red flag law. Michigan will be the first state to hold a hearing on such legislation. Several other states, including Montana, Texas, Tennessee, Oklahoma, Wyoming, and West Virginia, have already enacted legislation proactively banning red flag laws. Red flag laws allow the government to confiscate firearms without a criminal charge or mental health adjudication, undermining basic due-process protections. Ex parte ERPO orders remove a constitutional right before the individual has notice or an opportunity to be heard. Michigan already has criminal laws, protection orders, and mental health procedures that address dangerous behavior with stronger due-process safeguards. The ERPO process is vulnerable to misuse during family disputes, divorces, or personal conflicts, with lasting harm even when accusations are unfounded. Confiscation based on predicted future behavior treats a fundamental right as a revocable privilege rather than a protected liberty. ERPOs divert attention from addressing root causes such as mental health care access and enforcement of existing laws. Repealing the ERPO law restores clear, constitutional standards: charge crimes, treat mental illness, and protect rights when neither applies. While we do not expect a vote on this legislation yet this year, we encourage responsible gun owners who are available to attend the committee hearing as a show of support to offset expected attendance from opponents.
