Since January, the Trump administration has overstepped the boundaries of the law — stretching executive power beyond legal limits and escalating its attacks on the most vulnerable members of immigrant communities — unaccompanied children. They thought no one would stand in their way.
They were wrong.
When the Trump administration tried to rip vulnerable children from shelters in Texas and Arizona — children who woke up to strangers telling them they were being put on planes to the very countries they fled from — we moved instantly.
Within hours, we filed an emergency lawsuit in partnership with the Institute for Constitutional Advocacy and Protection (ICAP) and the National Center for Youth Law (NCYL), and the court intervened just in time, as at least 76 frightened children sat on planes on airport runways.
A federal court ruled that the Trump administration is now prohibited from removing our clients from the country while our case moves forward. The protection covers all Guatemalan unaccompanied children in the custody of the federal government who have not completed their legal process before an immigration judge.
Significantly, the court made clear that this does not give the government permission to do the same thing to unaccompanied children from other countries. This is a critical message given alarming reporting that the Trump administration wanted to target unaccompanied children from other countries in the same manner.
The court’s decision prevented severe and irreversible harm, but our fight is far from over.
We’re prepared to challenge every illegal attack, every abuse of power, and every attempt to send a child into harm’s way. But we need fierce advocates with us — unafraid and unrelenting.
