Bold Alliance is the lead plaintiff in a new federal lawsuit, filed this week in Montana, that challenges another Trump administration attempt to rubber-stamp approval of the Keystone XL pipeline. [1]
The new lawsuit -- Bold Alliance v. U.S. Dept. of the Interior -- argues that the U.S. Bureau of Land Management illegally approved a permit for the Keystone XL pipeline, based on outdated and insufficient environmental reviews, including outdated oil spill response plans.
Joining Bold as co-plaintiffs in the lawsuit is the same team of environmental groups and attorneys who just had the huge NoKXL win at the U.S. Supreme Court -- NRDC, Sierra Club, Center for Biological Diversity, and Friends of the Earth. The current status of that lawsuit means TransCanada remains prohibited from constructing KXL across U.S. waterways using an illegal Clean Water Act permit while the case moves forward. [2]
We filed this new lawsuit because along with the Army Corps, the Trump administration's Bureau of Land Management also broke bedrock environmental laws when it approved a permit for KXL.

Our new lawsuit argues that the BLM based its approval of KXL on the same error-filled environmental reviews that this very same court previously ordered the government to fix. [3]
The BLM's review also ignored grave risks posed by the pipeline, such as the consequences of a catastrophic oil spill -- in violation of its obligation to act as a steward of the land and protect public health, safety, and the environment.
Despite our Supreme Court win, as well as ongoing legal challenges from Indigenous Environmental Network, Rosebud Sioux Tribe, and Assiniboine and Sioux Tribes of the Fort Peck Indian Reservation, TransCanada and the Petro-State of Alberta continue to press forward with "pre-construction" of KXL mancamps, pump stations, and pipe yards, all in the midst of the coronavirus pandemic.
TC Energy (TransCanada's new corporate name) and Alberta Premier Jason Kenney -- who recently provided a $7 billion+ bailout of the KXL project on the backs of the province's taxpayers -- have even been trumpeting the launch of construction of segments of the pipeline within Canada. [4]
TransCanada and Alberta are shamefully and senselessly endangering communities and workers during Covid, for a pipeline that Democratic Presidential Nominee Joe Biden has pledged to rescind the permits for if he is elected -- and analysis has concluded he would have broad authority to even order pipe removed from the ground. [5]
Bold will continue to fight in the courts, and to organize and support landowners and Pipeline Fighters locally to oppose the various permits TransCanada is still seeking in Nebraska.
