Hi John,

We just won a major victory -- but the fight isn't over.

Recently, Color Of Change and so many advocates successfully defeated Big Tech's attempt to sneak AI preemption language into the National Defense Authorization Act (NDAA). House Armed Services Chairman Mike Rogers shut it down, saying he wouldn't add provisions without bipartisan committee support. Senate Ranking Member Jack Reed backed him up, declaring “there should be no deal that gives Big Tech free rein & takes away states' rights.”

Big Tech's response? They went straight to Trump for help.

Less than 48 hours after losing in Congress, the Trump administration leaked a draft executive order attempting to strip states of their power to protect us from AI discrimination. This is a coordinated attack. After hosting a White House dinner with Elon Musk, Nvidia CEO Jensen Huang, and OpenAI CEO Sam Altman, Trump is now doing their bidding.

The order would direct the Department of Justice to sue states over their AI laws and withhold federal broadband funding from states that refuse to comply.1 Trump is trying to use executive overreach to go around Congress, even with a 99-1 Senate vote rejecting their plan.

Here's what's at stake:

For years, Color Of Change has fought to stop AI systems from discriminating against Black communities -- algorithms that underpay Black gig workers, facial recognition that misidentifies Black people, and AI that denies us jobs and loans. We've picked these battles at the state level because states can act faster than Congress. Our Black Tech Agenda tells states how they can protect Black communities.

If Trump succeeds in bullying states into backing down, every protection we've fought for disappears, and Black communities get hit first. States have passed laws to protect children from harmful AI, stop discriminatory hiring algorithms, and require transparency. Trump wants states too afraid of lawsuits and funding cuts to protect us.

This is why Big Tech and Trump are working together: to make sure no one can stop them from profiting off discrimination.

CALL CONGRESS TO OPPOSE TRUMP'S AI EXECUTIVE ORDER

Trump cannot legally stop states from enforcing their AI laws. Only Congress has that power, and Congress already rejected preemption. But he can try to bully states with expensive lawsuits, threats of funding cuts, and legal uncertainty. We cannot let him win.

Join Color Of Change and tell Congress to fight back!

Until Justice Is Real,

Color Of Change
