ACLU Supporter, it's official: We're going to the Supreme Court to protect birthright citizenship.
When President Trump issued an executive order on his first day in office, unconstitutionally attempting to deny citizenship to certain American-born babies, the ACLU jumped into action, suing within just 2 hours. We've now brought two lawsuits to challenge this order.
Now, the Supreme Court has announced that they'll hear oral argument in our birthright citizenship case this term.
Federal courts around the country have consistently rejected President Trump's attempts to strip away this core constitutional protection. We've won key protections along the way, including a nationwide block on the president's executive order as our litigation continues. And now, we're ready to wage this fight at the Supreme Court, and strike down this harmful order once and for all.
Depriving any U.S.-born child of their citizenship would be devastating and profoundly cruel. The president's action goes against a core American right that has been a part of our Constitution for over 150 years. The president's order violates more than a century of Supreme Court precedent. It's a flagrant attack on immigrant communities and all our constitutional rights. It seeks to repeat one of the gravest errors in American history by creating a permanent subclass of people born in the U.S. who are denied full rights as Americans.
Every child in the United States should be born with the same rights as every other child. That's a core principle of the Constitution, and something that the ACLU will always fight to protect.
