Extended Emergency rulemaking related to SSB 5393 Closing the Rainier school by June 30, 2027

You have been identified as an interested party for rulemaking activities related to the DSHS Behavioral Health and Habilitation Administration’s work on residential habilitation centers. Extending the previous emergency rulemaking is necessitated by the legislature’s passage of SSB 5393, Closing the Rainier school by June 30, 2027. This legislation directs that DSHS will not permit “any new long-term admissions” to Rainier School as of July 27, 2025, and no new admissions as of June 30, 2027, except those clients who have return rights as defined in the bill.

WSR 25-23-042 [ [link removed] ] serves as the notice of extended emergency rules. *SHS-5098.3* [ [link removed] ] is the text of the emergency rules that has gone into effect.

This extension of the emergency rules was necessary to give the department more time to complete permanent rulemaking efforts while maintaining compliance with SSB 5393. The extended emergency rule is effective as of November 13, 2025, through March 13, 2026.

As previously notified, in conjunction with the emergency rules, the process of permanent rulemaking on the same topic is ongoing. *WSR 25-15-137* [ [link removed] ] serves as notice of permanent rulemaking efforts.
