Gov. Lamont and his Socialist Lawmaker Supporters for HB 8002
Under the guise of a sudden Housing Emergency (that could not wait less than two months) a necessary emergency legislative session paved the way with HB 8002 for Hartford to take over local control of how each town and city determines their local zoning.
While families traveled home for the Thanksgiving Holiday, Gov. Lamont quietly signed this bill into law.
Under HB 8002, the power of local zoning has been taken away by this “emergency” statute and newly formed regional planning associations will replace local control development and zoning.
This is the first step in the destruction of local control and it will not stop at housing. A new layer to the cake has been added and Nutmeggers will be funding it. HB 8002 paves the way for school districts to become regional and BOE’s and BET’s may soon have their powers pulled by Hartford. HB 8002 and all of Lamont’s recent emergency policies and bills follow the Socialist/Communist playbook - Centralize Power At All Costs & All Roads and Tribute goes to Hartford.
This is opposite to our Constitutional Republic principles and the 10th Amendment that reserves power to the States and in turn, the local governments that were created to represent the needs of their constituents.
Although zoning authority is a delegated power, HB 8002 well exceeds zoning by imposing mandates on towns to determine their housing mix and location. However, Hartford does not shoulder the burdens of infrastructure, parking and other consequences and imposes these emergency housing mandates.
The Housing “crisis” is likely a response to accommodate the increase in demand from illegal immigration as Connecticut is a sanctuary state and now we all shoulder the burden of illegal immigration and increased demands on state benefits like SNAP, Husky and other social service programs. HB 8002’s mandate effectively forces towns to illegally aid and abet unvetted illegal aliens in violation of Federal Immigration Law. The only sanctuary that Nutmeggers can take from these oppressive policies is an exodus to Florida or other southern states.
What other consequences does 8002 impose?
To meet the requirements of HB 8002, towns will require sewer upgrades, loss of available parking (as off-street parking is not required for certain developments), increased traffic. HB 8002 allows for Transit Oriented Development. that allows for denser housing development as of right within ½ mile of the transit station with the intention to turn your local train stop or bus stop into a densely populated commercial and residential hubs, despite the fact that Connecticut has no significant economic growth due to harsh policies just like HB 8002.
HB 8002 was passed by the Socialist leaning one party Democrat party and its Mamdani wannabe Governor Lamont who is appeasing the socialist left.
Enough with the No Kings – its time for a No Comrades Movement
Socialism has never worked as a form of government and the Democrat attack on President Trump under the No Kings movement should be replaced with the No Comrades Movement where our leaders will now be addressed with the title of Comrade starting with Comrade Lamont.
All problems have solutions – How do we Fight HB 8002?
There are credible legal argument that can be made to challenge this legislation that far exceeds its legislative power that goes well beyond zoning.
LEGAL CHALLENGES
The Tenth Article of the Connecticut State Constitution, regarding Home Rule.
Section 1 of the State Constitution Provides:
SEC. 1. The general assembly shall by general law delegate such legislative authority as from time to time it deems appropriate to towns, cities and boroughs relative to the powers, organization, and form of government of such political subdivisions. The general assembly shall from time to time by general law determine the maximum terms of office of the various town, city and borough elective offices. After July 1, 1969, the general assembly shall enact no special legislation relative to the powers, organization, terms of elective offices or form of government of any single town, city or borough, except as to (a) borrowing power, (b) validating acts, and (c) formation, consolidation or dissolution of any town, city or borough, unless in the delegation of legislative authority by general law the general assembly shall have failed to prescribe the powers necessary to effect the purpose of such special legislation.
HB 8002 removes the constitutionally protected power of a town to control under the pretex that this bill is just zoning legislation.
If this law is not vigorously fought in the courts the Hartford, Comrade Lamont and his cohort of loyal socialist democrats will continue to increase their power. If they are successful here, the state takeover of education could be next.
The Socialist Future of taking over the legal powers of the towns with a destruction of the unique character of our towns that attract people to live here will make these towns unattractive to the wealthy tax payers that fund the state budget.
HB 8002 and other oppressive bills will only accelerate the exodus to Florida and southern states movement. It is already happening and the only influx to Connecticut are those fleeing Mamdani in New York and those illegal immigrants welcomed with open arms by Comrade Lamont and AG Tong and their minions.
Say Goodbye to a Local Tax Structure
Funding for these commandeering programs can only be possible with a new tax regime. Town taxes will be replaced by State Property taxes that will fund the entire states public education system. Under equity, the wealthier towns will be forced to fund the poorer towns through this re-distributive property tax. These funds will be directed by the new states central planning authority and will not return to those wealthier towns.
Take Back Local Control
At the press conference for HB 8002, Gov. Lamont stated - “This bill tells mayors and first selectmen ‘What do you want your town to look like in five or 10 years? Start planning accordingly. Where do you want that housing to go? Are you going to zone accordingly? What else do you need? We want to be your partner,’”
Local Towns are Not A Partner they are a Forced Participant
Under HB 8002, Municipalities must create their own housing growth plan, or they must participate in a Council of Government (COG)-this newly created regional housing growth plan and provide their affordable (deed-restricted) units growth plan.
Connecticut’s First Selectman must join forces against the Socialist Democrat Run State Legislature and Socialist Governor and fight for the right to Connecticut citizens to live free in self governing towns.
They must challenge these takings by Hartford with the understanding that local zoning is first with the end game being a full takeover of the town budget and the rise of regional government like county government and new taxes to cover these unfunded state mandates and rising operational expenses (debt, salaries, infrastructure). Expect increased property taxes, increased sales taxes, new licensing and service fees.
