America First Legal Demands Repeal of Biden-Era Rule That Uses Race to Determine Kidney Transplant Recipients

AFL filed a petition for rulemaking with the federal government urging the U.S. Department of Health and Human Services (HHS) and the Centers for Medicare & Medicaid Services (CMS) to repeal a Biden Administration regulation that injects race and “equity” into America’s organ-transplant system. The Increasing Organ Transplant Access (IOTA) Model pressures hospitals to adopt race-conscious allocation policies—effectively allowing patients to be passed over for lifesaving kidneys because they are de-prioritized based on their race and other immutable characteristics rather than urgent medical need.
This rule violates federal civil-rights laws, exceeds CMS’s authority, and dangerously incentivizes hospitals to chase transplant quotas in an already fragile system. AFL is calling on the federal government to immediately repeal this unlawful regulation and return to race-neutral, merit-based standards so that organ allocation is determined by medical criteria—not DEI-driven social engineering.

America First Legal Urges the U.S. Supreme Court to Restore Constitutional Guardrails After Rogue Judges Enjoin Texas Election Map

AFL, working with outside counsel, has filed a significant amicus brief in the U.S. Supreme Court, urging it to halt and overturn a lower-court decision that blocked Texas’s 2025 congressional map. AFL’s brief argues that the lower court’s ruling tramples on legal precedent and state sovereignty, contending the lower court’s panel used a watered-down injunction standard, invented an impossible test for legislative motive, and threw an active election cycle into chaos.
Forcing states to prove a single “purely partisan” motive effectively guarantees false findings of racial intent and invites federal courts to hijack state election systems. AFL urges the U.S. Supreme Court to restore constitutional order and stop federal judges from overriding state-drawn maps on the eve of elections.

America First Legal Calls on U.S. Department of Justice to Stop Chicago’s Illegal Race-Based Government and Police Practices

AFL filed a civil rights complaint with the U.S. Department of Justice, urging the federal government to investigate Chicago for its open and pervasive race-based system of governance that violates Title VI and VII of the Civil Rights Act. Chicago and its police department have hardwired discriminatory racial preferences into hiring, promotions, training, and policing under the guise of “equity,” all while receiving federal funds that prohibit such discrimination.
These policies undermine the rule of law and the essential mission of law enforcement to protect all citizens equally. AFL will continue to expose and challenge these race-driven mandates in Chicago and in other cities adopting similar “equity” agendas.
