This week, a federal court dismissed charges against former FBI Director James Comey and New York Attorney General Letitia James—charges that were levied as part of Trump’s assault on his political opponents by his interim U.S. Attorney appointee, Lindsey Halligan.
The judge dismissed those charges on the basis that Halligan wasn’t even lawfully appointed, meaning any actions she took, including these baseless indictments, were totally invalid under the provisions of the Preserving United States Attorney Independence Act that I championed.
That law requires Senate confirmation of U.S. Attorneys within 120 days. The Trump Administration ignored that law when it installed Halligan long after the interim window expired.
The dismissal of the charges came after I filed a legal brief with my colleagues urging the District Court for the Eastern District of Virginia, where Halligan was illegally appointed to serve, to reject Halligan’s appointment and throw the charges out.
Alina Habba, New Jersey’s equivalent U.S. attorney, has also been illegally appointed and installed to do Trump’s dirty work. It’s time for her to go, too.
