As I wrote to you earlier this week, a three-judge panel in El Paso federal court delivered an important victory for fair representation in Texas, blocking the mid-decade congressional map President Trump demanded and that Governor Abbott and Republican legislators provided—a map the court found was unconstitutional.
In a two to one decision, the Court did not mince its words. It stated directly, "The public perception of this case is that it’s about politics. To be sure, politics played a role in drawing the 2025 Map. But it was much more than just politics. Substantial evidence shows that Texas racially gerrymandered the 2025 Map." The Court has ruled that the Trump/Abbott map violates the Constitutional rights of Black and Hispanic Texans in violation of the 14th and 15th Amendments. They confirmed that the actions taken by Abbott and Legislature were driven by their desire to undermine the rights of Black and Hispanic Texans. Their claims of partisan motivations were rejected.
Texas Attorney General (and Senate candidate) Ken Paxton has already appealed, taking this fight to the U.S. Supreme Court, seeking an emergency stay of this ruling from the U.S. Supreme Court. Friday night, Justice Alito issued a temporary administrative stay and ordered the plaintiffs to respond to the motion by Monday at 5:00pm. The full Court will review filings and see arguments supporting the District Courts' ruling that the Trump/Abbott map is an illegal racial gerrymander.
Preparing the response to the motion to stay and to defend the injunction at the Supreme Court takes significant resources. The Texas Justice Fund has been at the forefront of this work to ensure that Texans have fair maps and a fair chance to be heard. As they prepare for the next hugely consequential stage of this battle, they need our support.
