This week, I was a guest on the American Constitution Society’s podcast Broken Law. Our conversation covered the 22nd Amendment and President Trump’s threats to seek a third term. Here’s what I had to say:

The 22nd Amendment ended a 150-year debate over presidential term limits. Its language is clear: “No person shall be elected to the office of the President more than twice.”

But Trump has continuously shown a willingness to flout the Constitution and has flirted with the idea of running for president again.

Because he’s publicly threatened to break these term limits, it’s essential that there is as much information out there for the public—and the courts—to understand that this is a question that has already been settled.

President Trump's penchant for illegality and his desire to upend the Constitution have forced us to learn things about it that have been dormant for some time—including the 22nd Amendment.

A supermajority of both chambers of Congress passed the amendment. Forty-one state legislatures ratified it and it officially took effect after 36 of the then 48 states ratified the amendment in February 1951.

The amendment received overwhelming support across the 41 state legislatures that ratified it and the ratifying states represented every region of the country, often passing it with bipartisan support.

Despite the nearly 75 years since the ratification of the amendment, Trump thinks he can find a loophole to get around presidential term limits.

It’s important to remind him: when the 36th state ratified this amendment, it settled the question and that means it’s now been settled for decades—whether Trump likes it or not.

The idea that Congress or the American people would just accept that the 22nd Amendment can be ignored because the president wants to hold onto power shouldn’t even be up for debate.

So no matter what Trump may claim, there is no wiggle room when it comes to the 22nd Amendment or the Constitution—and it’s on us to hold the president accountable.
