An alarming legal development attempted to put marriage equality back on the line.

The Supreme Court considered hearing former Kentucky county clerk Kim Davis’ appeal — a case that includes a request to overturn Obergefell v. Hodges. This landmark 2015 decision secured marriage equality nationwide.

And while the Supreme Court declined to hear this case, it has signaled it wants to take up marriage equality. And there are already several more challenges in the works.

Lawmakers in at least nine states are pushing bills aimed at weakening marriage rights for same-sex couples. Alarmingly, five of those proposals explicitly call on the Supreme Court to overturn Obergefell v. Hodges.

In Texas, the state Supreme Court recently ruled that judges can refuse to perform marriages based on “sincerely held religious beliefs.”
