Dear John,

Earlier this week, I shared some amazing news with you – we won a huge victory in our case against the State of Oregon over a radical law forcing us to include abortion in the health insurance benefits we offer our employees (read our press release here [[link removed]]).

Winning our appeal means our case has been remanded back to the lower court, and we have strong reason to hope for a final outcome that will clearly establish our right to an exception.

Here are the details on what happened and what happens next:

On Friday, the 9th Circuit Court of Appeals ruled 2-1 to reinstate our case against Oregon (Oregon Right To Life v. Stolfi) after it had been wrongly dismissed by a district court. The judge who wrote the majority opinion, Judge Lawrence VanDyke, wrote an incredible concurrence arguing that the law in question – the Reproductive Health Equity Act – is discriminatory and should be subject to “strict scrutiny” by the lower court. He also urged the district court to grant us a preliminary injunction because of our likelihood of succeeding on the merits of our First Amendment claim (read the full opinion here [[link removed]]).The district court has now been instructed to reevaluate our First Amendment complaint against Oregon’s law.

This is an incredible victory in our years-long legal battle. So many of you have sent congratulations, prayers, and words of encouragement in response to my email on Tuesday. I’m deeply grateful for all of your support!

As promised, I’ll continue to keep you updated, because this fight isn’t over yet. Our case has been revived, but we still need to push for a favorable ruling by the district court.

That takes time and resources, but we’re committed to this to the very end – we won’t ever give up on defending our religious liberty and conscience rights.
