California's Device-Based Age-Verification Bill Does Not Apply To Adult Sites

California’s recently passed age-verification bill, AB 1043 ( [link removed] ) , does not apply to adult websites. The bill requires device manufacturers and app stores to collect a user’s birthdate or age and provide an API for apps (but not websites) to determine whether a user is under 18 years old. Apps must use the age information to “manage the delivery of age-appropriate content.”

While the bill had originally included language that would require the age signal API be made available to adult websites, a last-minute amendment removed that provision. The Free Speech Coalition has long advocated for a device-based solution that would allow adult websites to block minors using similar technology.

The new law will take effect January 1, 2027.

FSC has released a comprehensive guide to help businesses navigate the rapidly changing patchwork of state age verification laws. With half of U.S. states now enacting mandates—each with different thresholds, methods, and penalties—the 185-page toolkit provides plain-language explanations, state-by-state summaries, and practical compliance considerations. It will be updated regularly as new laws emerge and court challenges proceed. The full toolkit is available to FSC members, with an abridged version offered to non-members.

Pennsylvania Lawmakers Propose Titty Tax

Pennsylvania lawmakers have introduced a bill proposing an additional 10% tax on online adult content purchases and subscriptions, on top of the state’s existing 6% sales tax. Supporters frame it as a way to increase revenue, but critics argue the tax would primarily harm independent creators and performers, pushing consumers toward free, unregulated content instead of platforms where performers are paid and age verification is enforced. The Free Speech Coalition’s Mike Stabile has dubbed it the “titty tariff,” noting that targeting a specific type of speech or industry sets a dangerous precedent. By disincentivizing paying for adult content, the proposal could undermine performer safety, financial stability, and consumer access to legal, consensual content. Read more on Reason... Wisconsin Wants To Force All Adult Sites To Block VPNs With A New Age Verification Bill

Wisconsin’s age verification bill (AB 105/SB 130) would require adult sites to block access for users connected via VPN, with penalties for sites that don’t comply. The measure has passed the Assembly and is now in the Senate, mirroring a Michigan proposal and reflecting growing attempts to treat VPNs as obstacles to age checks. Experts note major technical and civil liberties concerns, since websites generally can’t determine a user’s real location behind a VPN and blocking could push users to share sensitive IDs without the protection of encryption. The bill’s scope and enforcement remain unclear, including whether social platforms would be covered and who decides what content is “harmful to minors.” Read more on Tech Radar... Porn Sites Not Asking For Age Verification Despite New Ohio Law

Nearly a month after Ohio’s new age verification law took effect, most major porn sites are not complying. The law requires users to upload government ID or other identifying documents before accessing explicit content, but the Ohio Attorney General reported that only one out of the top 20 sites is verifying age. Pornhub’s parent company argues the site qualifies as an “interactive computer service” under federal law and is therefore exempt, adding that mandatory ID upload could push users toward unsafe, unregulated sites and increase privacy risks. The Attorney General has threatened civil action if sites do not comply within 45 days, and legislators expect the issue will be settled in court. Read more on Dayton Daily News... Berlin’s Porn Film Festival celebrated its 20th year, continuing its mission to blur the line between erotic film and art while creating an inclusive, sex-positive space for filmmakers, performers and audiences. The six-day festival showcased feminist, queer, kink and LGBTQ+ creators, emphasizing ethical, community-driven approaches to erotic media and offering workshops, panels and its Adult Industry Forum. Filmmakers described the event as a rare platform for work that challenges stigma, censorship and rigid moral boundaries, with films this year centering on themes like aging, disability, sexuality and queer resistance. Organizers and participants stressed that erotic cinema deserves the same cultural space and artistic legitimacy as any other genre, especially at a time when censorship and anti-queer policies are growing globally.
