We’re on the field, and they’re moving the goalposts.
Earlier this week, we told you that the Montana Attorney General has deemed our ballot initiative language “legally insufficient,” and gave us 10 days to appeal that decision, per a department memo.
I’ll tell you what I told the Montana Free Press: a legal-sufficiency review is a technical gatekeeping function. The memo strays into policy and predictive litigation arguments that go beyond that role.

This is a politically motivated roadblock, and we’re appealing this decision to the state Supreme Court.
This is not a red-or-blue issue — we have a wide array of endorsements from Democrats and Republicans alike, including former governors Mark Racicot and Steve Bullock, former senator Jon Tester, and former Cascade County clerk Rina Fontana-Moore.
Everyday Montanans are also overwhelmingly supportive of our language. We just got our poll back, and 76% of Montanans (Democrats, Republicans, and independents!) support our ballot language!
Those who want to provide political cover for millionaires and billionaires buying our elections will throw anything they can at The Montana Plan because they know that if we’re on the ballot next year, we’ll win.
