John,
Since taking office for the second time, President Trump has repeatedly suggested that he might attempt to seek a third term as president.
Despite what he may claim or “joke,” under the 22nd Amendment, the Constitution strictly prohibits any person who has been elected president twice from being elected to the office again.
Given his continuous public threats that he may test these term limits, we thought we’d issue a reminder: The 22nd Amendment is not optional. It’s that simple.
CREW is working to hold Trump accountable and ensure that the Constitution, which he swore an oath to uphold, is enforced. Help us keep up this work by donating to support our efforts today →
When it comes to the 22nd Amendment, CREW has the facts—and we’re committed to raising awareness and defending the Constitution for as long as it takes.
Here’s what you should know:
The 22nd Amendment states very clearly: "No person shall be elected to the office of the President more than twice."
The amendment was voted out of Congress by a supermajority vote in both chambers. It was ratified by 41 state legislatures and officially came into effect after 36 of the then 48 states ratified the amendment in February 1951.
Support for the ratification was overwhelming across the 41 state legislatures that ratified the amendment. The ratifying states represent every region of the country and were often passed with bipartisan support.
Despite the long-standing history of the amendment, Trump seems to think he’s above the law and appears to want to treat the Constitution and presidential term limits as negotiable.
Due to his authoritarian posturing, the history of the 22nd Amendment’s passage—led by Republicans in many states—and the intent of those who ratified it, is newly relevant.
John, the 22nd Amendment exists for a reason: To prevent our democracy from slipping into a monarchy.
No matter what Trump may claim, there is no wiggle room in the Constitution. The 22nd Amendment is not up for debate. No person—including him—can be elected president more than twice and CREW’s working to ensure the Constitution is enforced.
