America First Legal’s Petition for Proof of Citizenship Rule Draws Over 350,000 Comments and Support from 14 States, Members of Congress, and Election Integrity Leaders

WASHINGTON, D.C. – America First Legal’s (AFL) petition for rulemaking to the U.S. Election Assistance Commission (EAC) hit another milestone this week, with the close of the public comment period. This marks a historic development in the fight for election integrity. AFL’s petition to require documentary proof of citizenship for federal voter registration drew overwhelming national support, with more than 350,000 comments submitted by the American people.


The petition also earned public support from fourteen states, led by Texas Attorney General Ken Paxton, as well as from Members of Congress, leading election integrity organizations, and state election officials. This coalition represents one of the broadest demonstrations of public demand for commonsense ballot protection measures in modern history.


AFL’s petition exposes a fatal flaw in the current system: the EAC’s registration form does not require proof of citizenship, relying only on self-attestation. AFL’s petition calls on the EAC to fix this loophole and require real, verifiable documentation of citizenship to ensure that only American citizens have a voice in American elections.


“America First Legal’s petition sparked a nationwide movement,” said Gene Hamilton, President of America First Legal. “From state leaders to the grassroots, the message is clear: the honor system is not enough. The EAC must act to defend the rule of law, protect the integrity of our elections, and restore confidence in the ballot box.”


AFL’s petition for rulemaking now moves to the EAC for formal consideration. The Commission has an opportunity—and a duty—to act decisively in defense of the Constitution, the American people, and the integrity of the vote.


The states supporting AFL’s petition include: Texas, Alabama, Iowa, Arkansas, Kansas, Georgia, Louisiana, Idaho, Nebraska, Indiana, Ohio, South Carolina, West Virginia, and South Dakota. 


The U.S. Senators supporting the petition include: Ted Cruz (Texas), Jim Banks (Indiana), Marsha Blackburn (Tennessee), Ted Budd (North Carolina), John Cornyn (Texas), Cindy Hyde-Smith (Mississippi), Ron Johnson (Wisconsin), Roger Marshall (Kansas), and Bernie Moreno (Ohio).


The U.S. Representatives supporting the petition include: Eli Crane (Arizona), Andy Biggs (Arizona), Byron Donalds (Florida), Pat Fallon (Texas), Andy Harris (Maryland), Clay Higgins (Louisiana), Ronny L. Jackson (Texas), Mary Miller (Illinois), Barry Moore (Alabama), Riley Moore (West Virginia), Derek Schmidt (Kansas), and W. Gregory Steube (Florida).


The organizations supporting the petition include: America First Policy Institute, Association of Mature Citizens, Election Integrity Network, Public Interest Legal Foundation, Republican National Committee, Restoring Integrity and Trust in Elections, and Texas Public Policy Foundation.
