Senators Alex Padilla and Gary Peters filed an amicus brief in our lawsuit challenging the Trump administration’s attempt to purge voter rolls using secret databases.
We’re also suing the National Archives and Records Administration for failing to take enforcement action over these violations.
They argue that the overhaul of the Department of Homeland Security’s SAVE program “to sift through voter rolls with no direct notice to Congress violates the Privacy Act and lacks legal authority.”
This adds important momentum to our case as we head into a hearing next week on our preliminary injunction request.
The senators’ brief supports what CREW and our partners have been saying all along: the Trump administration’s consolidation of sensitive, legally protected information on millions of Americans is unlawful—and it’s a threat to eligible voters’ rights.

Our complaint alleges that the Trump administration has unlawfully transformed the DHS’s SAVE system into a national citizenship database, secretly pooling data across agencies.
This information—which the government itself has admitted is unreliable—is reportedly already being used by some states to purge voter rolls and open criminal investigations based on citizenship information that may not be accurate.
This illegal action threatens to disenfranchise eligible voters, and it’s a direct threat to voting rights, which are the foundation of our democracy.
That’s why CREW took action alongside our partners and on behalf of millions of impacted Americans to block the administration’s efforts to consolidate and misuse this sensitive data. With this year’s election rapidly approaching, we acted quickly to ask the court to provide emergency relief in our lawsuit to stop the Trump administration from purging voter rolls before it’s too late.
