Dear Friend, |
The Trump administration just announced $625 million in new subsidies to keep the coal industry alive. This isn’t harmless nostalgia — it’s killing people, it’s destroying our climate, and it’s ravaging our public lands. |
We refuse to let Trump’s coal fantasies define our present or our future. So we’re fighting back in court. |
- In Michigan: Earthjustice has active litigation to shut down a coal plant Trump’s sham “energy emergency” has kept running past its scheduled retirement. In the coming months, we will fight more mandates like this one across the country.
- In Montana: Earthjustice has fought expansions of some of the country’s largest coal mines for years, and will continue to protect communities against Trump’s plans to authorize reckless new mining in the area.
- Across America: The Department of the Interior intends to open 13.1 million acres of public land to coal leasing. Wherever the Trump administration tries to sell off our public lands, we will be there, fighting back.

Trump is abusing the power of the federal government at a historic scale, but we can fight back anywhere in the country for two reasons: First, our incredible partners are on the ground in every state, and they can leverage our free legal representation to stop Trump’s policies; and second, people like you fund our lawsuits with your donations. |
Donate today to fight back against the Trump administration, keep coal in the ground, and protect our future on planet Earth. |

Trump’s coal plan is not just bad for our planet — it is poisonous to our communities and economically senseless. |
Wind and solar are cheaper, and this plan is estimated to drive up energy bills by billions of dollars annually. |
Coal is a major polluter of air and water, and part of Trump’s efforts to revive the industry is to weaken or even abandon clean air and water standards. |
Earthjustice attorneys are fighting rollbacks to health and environmental protections that would permit coal plants to continue to pollute our air and water. |
The coal industry is vast, and we are fighting back in multiple venues, including states, federal courts, and public utility commissions. Below are just a handful of the various arenas where we are fighting against coal. |
Public Lands for Coal Mining |
The Trump Administration is pushing to expand strip mining for coal across the West, including areas near our beloved national parks. New coal leasing threatens our climate and public lands. |
Earthjustice is fighting mine expansions in Montana and will challenge senseless new coal leasing throughout the region. |
Coal Plant Retirements |
The Trump administration is trying to override state and public utility commission decisions to retire coal plants and keep aging coal plants running. These moves threaten public health and clean, affordable energy. |
With the largest public-interest clean energy litigation program in the U.S., Earthjustice litigates before Public Utility Commissions to speed the transition away from coal and gas and to build out clean energy. |
Emergency Power Orders |
The Department of Energy is abusing emergency powers to keep coal plants like Michigan’s J.H. Campbell open. This is not just shortsighted — it’s expensive. The total cost of keeping these unnecessary coal and gas plants open could add more than $3 billion to consumers’ electric bills every year by 2028. The cost to comply with just one emergency order was nearly $1 million per day in the first five weeks of that order. |
Earthjustice is challenging these illegal orders in court and working with state leaders to stop this dangerous misuse of authority. |
Coal Ash and Coal Wastewater Rules |
The EPA is proposing delays that would let coal plants put stronger coal ash and clean water regulations on hold until 2030 or later — putting water and health at risk. Earthjustice has led the fight for clean air and clean water protections against coal pollution for over a decade. We will not allow a rogue EPA to put people’s health at risk for the sake of coal company profits. |
The coal industry is big — and the federal government is even bigger. That’s why your support is so crucial. In every lawsuit, we represent our clients free of charge thanks to your support. |
