CREW filed a Hatch Act complaint against the Trump administration.The Hatch Act prohibits any executive branch employee from “us[ing their] official authority or influence for the purpose of interfering with or affecting the result of an election.” So CREW filed a complaint because several Trump administration officials, including White House Press Secretary Karoline Leavitt, Treasury Secretary Scott Bessent, Secretary of Homeland Security Kristi Noem and Senior Counselor for Trade and Manufacturing Peter Navarro, made partisan statements about New York City mayoral candidate Zohran Mamdani’s campaign in their official capacities. The Trump administration appears to believe there is a Mamdani-specific exception to the Hatch Act, but this is not the case and no such exception exists. There is no good reason for senior administration officials to be weighing in on the New York mayoral race or any of the candidates’ qualifications. This conduct is in clear violation of federal law.
This isn’t the first time CREW has pushed to hold our government officials accountable and it certainly won’t be the last. In fact, during Trump’s first term, Hatch Act complaints filed by CREW led to the OSC finding that a significant number of Trump administration officials had violated the Hatch Act, including former senior counselor Kellyanne Conway, whom OSC recommended be removed from federal service due to her multiple Hatch Act violations.
