Justice Clarence Thomas just told us exactly what we’ve feared: precedent
doesn’t matter. “Decided cases aren’t the gospel,” he said — and some may
have been based on “something somebody dreamt up and others went along
with.”
He’s not kidding. Thomas isn’t just talking hypotheticals — he’s signaling
that he, along with the conservative-majority Court, is coming for the
rights and protections millions of Americans rely on. That means nothing
is safe.
We’ve already seen the consequences:
* Roe v. Wade: decades of settled law ripped away in an instant.
* Birthright citizenship: under threat like never before.
* LGBTQ+ protections: hard-fought legal safeguards hanging by a thread
in courts that see precedent as “optional.”
And this is just the beginning. If precedent can be tossed aside on a
whim, every right, every protection, every law we rely on is at risk —
from healthcare and voting rights to environmental protections. The Court
is poised to strike down generations of law just to please Trump and his
allies.
