Our legal team’s nonstop efforts have resulted in critical voting rights victories over the past year:
* NEW HAMPSHIRE: The U.S. District Court in New Hampshire in May approved a consent judgment [[link removed]] in our lawsuit challenging the use of artificial intelligence to intimidate, deceive, and coerce voters, the first legal challenge of its kind. Our lawsuit, filed in March 2024, alleged that thousands of New Hampshire voters received robocalls using artificial intelligence to mimic then-President Biden’s voice. The calls falsely warned voters that participating in the primary would forfeit their right to vote in the general election, urging them to “save” their vote. Voice Broadcasting Corporation and Life Corporation have agreed to refrain from intimidating, threatening, or coercing voters in connection with U.S. elections and will implement a compliance plan to prevent the transmission of such messages in the future. * ARIZONA: In March, the U.S. Court of Appeals for the Ninth Circuit issued a powerful ruling [[link removed]] that protects Arizona citizens from anti-voter provisions in two 2022 Arizona state laws, H.B. 2492 and H.B. 2243. We joined the Campaign Legal Center and other plaintiffs to file an amended complaint in this case in July 2022, arguing that these laws impose burdensome and unnecessary proof of residency and citizenship requirements on voter registration even though voters are already required to attest to citizenship under penalty of perjury; prevent certain voters from voting by mail or voting in the presidential election; and mandate strict voter roll purges and unwarranted investigation of naturalized citizen voters. Our right to a free and fair vote is under threat like never before. The Trump administration is actively attempting to rig the 2026 election, directing the Department of Commerce to conduct a mid-decade census that excludes undocumented U.S. residents to redraw congressional districts. Trump pressured Texas Republicans to unlawfully gerrymander the state’s congressional districts to pick up five additional seats. The Supreme Court will rule on a case in the coming weeks that could further gut the Voting Rights Act of 1965 [[link removed]] . Trump has vowed to eliminate mail-in voting nationwide, violating states’ rights to legislate their election practices. The DOJ is requesting sensitive voter data from top election officials in several states.
Free Speech For People is working tirelessly to protect voters from suppression and intimidation in 2025 and beyond:
* TEXAS: FSFP is continuing to litigate an important, complex voting rights lawsuit [[link removed]] that it first filed in September 2021 on behalf of Mi Familia Vota and individual voters. The lawsuit seeks to overturn SB 1, a law designed to suppress votes from underrepresented communities. FSFP has litigated the case through a partial trial and appeals in its effort to protect voters across the state from a law that would criminalize routine voter education practices by civic engagement organizations, deprive people of their ability to obtain necessary assistance to vote, subject people to intimidation and interference by so-called “poll watchers,” and subject voters to other burdensome restrictions on their ability to vote by mail and by person. Part of the case went to trial in September 2023. FSFP is prepared to litigate appeals of still-pending parts of that case, and to bring MFV and the voters’ rights to court in the trial’s second phase.
* NEVADA: In January, we filed a motion [[link removed]] on behalf of the NAACP Tri-State Conference of Idaho-Nevada-Utah to dismiss a lawsuit filed by the Trump campaign and the Republican National Committee just weeks before the November 2024 general election. Their lawsuit seeks to unlawfully and unconstitutionally purge the voter rolls based on false and repeatedly debunked claims that non-citizens are casting ballots in elections. * COLORADO: In February, we filed a reply brief [[link removed]] challenging the dismissal of our case against the United States Election Integrity Plan (USEIP) for illegal voter intimidation, correcting the factual record and the defendants’ flawed legal assertions. The plaintiffs explain that despite making ad hominem attacks on the plaintiffs, the defendants' briefs “do nothing to rehabilitate the district court’s judgment, which rests on error after error.” Free Speech For People filed an opening brief in the appeal in November. The United States Department of Justice also filed that month an amicus brief in support of NAACP Colorado, LWV Colorado, and MFV’s appeal. Read more about the case here [[link removed]] .
