On September 27, President Trump posted on Truth Social, directing the National Guard to be deployed to Portland, despite the lack of any real emergency to warrant the deployment.
That same day, the state of Oregon and the City of Portland filed suit to block the deployment. Within days CREW moved to file an amicus brief on behalf of a historian arguing that the court should grant a temporary restraining order to the plaintiffs, given the lack of historic or legal precedent for Trump’s actions.
And a judge (appointed by President Trump) did just that over the weekend—blocking Trump’s deployment of the National Guard to Portland.This is a step in the right direction in our fight to hold Trump accountable and defend our democracy. Trump’s attempted deployment of the National Guard to Portland comes just months after he deployed the National Guard to Los Angeles and Washington, D.C. in an escalating authoritarian power grab.
As our amicus brief makes clear, the authority to call up state militias has only ever applied in cases of war, invasion or insurrection—not peaceful protests like the ones in LA and Portland.
Trump’s actions “find no support in American history or judicial precedent.” America’s founders actually opposed military involvement in domestic affairs, except in the most extreme circumstances.
History also shows that the courts have the authority to determine whether those conditions are met, not the president.
As our brief states, “Supreme Court decisions from the nineteenth century emphatically rejected the notion of unreviewable presidential discretion to deploy the military on American soil, dismissing the argument as repugnant to our founding principles.”
In short, there is simply no historic precedent or legal justification for these deployments. And the judge agreed—which is a critical win for the rule of law.
