*Skagit County dairy worker pleads guilty in $122K workers’ comp scam*

SKAGIT COUNTY — A Skagit County dairy worker who falsely claimed he was too injured to work has pleaded guilty to illegally taking workers’ compensation payments.

Efrain Alatorre Camarena, 58, pleaded guilty Sept. 17 to three counts of third-degree theft ̶ all of them gross misdemeanors. A Skagit County Superior Court judge ordered him to repay the Washington State Department of Labor & Industries [ [link removed] ] (L&I) over $140,000, which includes the $122,000 he stole plus interest.

Additionally, the judge sentenced Alatorre to 160 hours of community service and two years on probation.

Alatorre was accused of illegally taking more than $122,000 in workers’ compensation payments over three-and-a-half years while falsely claiming he was too injured to work. He has already started repaying L&I for the wrongfully obtained funds.

“We’re committed to catching the bad actors who cheat our state’s workers’ compensation system at the expense of the truly injured workers who need it most,” said Steve Reinmuth, assistant director of L&I’s Field Services and Public Safety division.

“When people get caught cheating, they will not only be prosecuted, they’ll have to repay what they took, and they’ll have a criminal record.”

*Injured chasing runaway cow
*In 2006, Alatorre injured his neck and back when he fell while chasing a runaway cow at a Skagit County dairy farm where he was working.

A doctor determined he couldn’t work because of his on-the-job injuries. In addition, Alatorre regularly signed official documents stating he was not working because of the injuries ̶ one of the requirements to receive payments to replace part of his lost wages.

He received the wage replacement benefits off and on for a total of nine years; the charges applied only to the final three years.

*L&I records check leads to investigation
*In 2023, L&I investigators conducting a routine comparison of L&I and state Employment Security Department (ESD) data discovered Alatorre was working despite telling L&I that he wasn’t able to. The ESD records, along with paystubs from another Skagit County dairy, revealed he had been working at the farm while he was receiving wage-replacement payments, charging papers said.

Investigators determined he earned over $172,000 working on the farm while collecting more than $122,000 in L&I workers’ compensation payments at the same time, from January 2020 through mid-August 2023.

The Washington State Office of the Attorney General prosecuted the case based on L&I’s investigation. L&I oversees the state workers’ compensation insurance system, which helps injured workers heal and return to work.

CONDADO DE SKAGIT — Un trabajador de una lechería del condado de Skagit que fingió estar muy lesionado para trabajar se declaró culpable de cobrar ilegalmente pagos del seguro de compensación para trabajadores.

Efrain Alatorre Camarena, de 58 años, se declaró culpable el 17 de septiembre de tres cargos de robo en tercer grado, todos ellos delitos menores graves. Un juez del Tribunal Superior del condado de Skagit le ordenó devolver al Departamento de Labor e Industrias del Estado de Washington [ [link removed] ] (L&I) más de $140,000, lo que incluye los $122,000 que robó más los intereses.

Además, el juez condenó a Alatorre a 160 horas de servicio comunitario y dos años de libertad condicional.

“Cuando se descubre a alguien engañando, no solo se le procesará, sino que también tendrá que devolver lo que se llevó y quedará con antecedentes penales”.

*Lesionado al perseguir una vaca fugitiva
*En 2006, Alatorre se lesionó el cuello y la espalda al caer mientras perseguía a una vaca fugitiva en una granja lechera del condado de Skagit donde trabajaba.

Un médico determinó que no podía trabajar debido a las lesiones sufridas en el trabajo. Además, Alatorre firmaba regularmente documentos oficiales en los que declaraba que no estaba trabajando debido a las lesiones, uno de los requisitos para recibir pagos que reemplazaban parte de su salario perdido.

Recibió beneficios de reemplazo de salario de forma intermitente durante un total de nueve años; los cargos solo se aplicaron a los tres últimos años.

*La verificación de los registros de L&I da lugar a una investigación
*En 2023, los investigadores de L&I que realizaban una comparación rutinaria de los datos de L&I y del Departamento para la Seguridad del Empleo (ESD, por su sigla en inglés) del estado descubrieron que Alatorre estaba trabajando a pesar de haberle dicho a L&I que no podía hacerlo. Los registros del ESD, junto con las nóminas de otra lechería del condado de Skagit, revelaron que había estado trabajando en la granja mientras recibía pagos de reemplazo salarial, según la acusación.

Los investigadores determinaron que ganó más de $172,000 trabajando en la granja mientras cobraba más de $122,000 en pagos del seguro de compensación para trabajadores de L&I al mismo tiempo, entre enero de 2020 y agosto de 2023.

La Fiscalía General del Estado de Washington procesó el caso basándose en la investigación de L&I. L&I supervisa el sistema estatal de seguros de compensación para trabajadores, que ayuda a los trabajadores lesionados a recuperarse y volver al trabajo.
