As we fight the Trump administration’s attacks on the environment, we are celebrating the victories you've helped us achieve.
This month, we are celebrating a win , a major victory in South Africa, good news in the fight against Enbridge’s Line 5 pipeline in Michigan, and a win for clean air in southern California.

Win Against Trump Administration Takedowns of Public Data

In a win for transparency and community safety, Earthjustice and our partners successfully pushed the EPA to restore public access to important chemical hazard data — without needing to file a lawsuit. After the Trump EPA quietly removed the Risk Management Program (RMP) Public Data Tool from its website earlier this year, communities were left in the dark about toxic threats from nearby industrial facilities. Earthjustice made arguments to restore the public database in a FOIA request, but the EPA refused to republish the information online. We appealed the decision and began preparing legal action, but thankfully never needed file. The EPA bowed to pressure, reversed course, and began reposting RMP information, making it once again accessible to the public.

Earthjustice has worked closely with partner organizations for many years to prevent and reduce harm from chemical disasters, and this work will continue as the Trump administration considers weakening the Safer Communities RMP Rule. Because when the Trump administration discards critical environmental protections, we fight back.

Victory in South Africa: Court Overturns Gas Plant Approval

In a major win for our partners at Natural Justice, the Supreme Court of Appeal of South Africa has overturned the environmental approval for a massive gas power plant proposed in Richards Bay. The court found that Eskom, South Africa’s state-run utility, failed to consider renewable energy alternatives, assess cumulative climate impacts, and provide meaningful public participation — especially by neglecting to publish materials in IsiZulu, the region’s primary language.

This was the first legal challenge to a gas power plant in South Africa and our first collaboration with Natural Justice. Earthjustice attorneys Ramin Pejan, Mae Manupipatpong, and Lauren Withey supported our partners in bringing this case, and it became a blueprint for over a dozen other gas plant challenges by Natural Justice. The Court of Appeal’s decision not only sends the Richards Bay project back to square one — it also sets binding precedent for all high courts in South Africa. We’re now strategizing with our partners on how to best leverage this ruling in other gas plant challenges.

A Win for Clean Air in Southern California!

Last month we had a big win for clean air and climate progress. The South Coast Air Quality Management District started a new pilot program to help families switch from gas-powered appliances to clean electric ones like heat pumps that don’t pollute the air.

The agency is putting $21 million into this program, with most of the money going to low- and middle-income families. If all goes well, the program could grow to $100 million or more! This victory is the result of years of hard work by Earthjustice, our partners and supporters like you.

Southern California has some of the worst air pollution in the country. Gas appliances in homes are now the biggest stationary source of smog-causing pollution in the region. They pollute more than all the cars and small trucks combined!

Replacing these appliances with clean electric ones will help families breathe easier, save money, and make homes safer.

Good News in the Fight Against Enbridge's Line 5 Pipeline

In a major development for our fight against Enbridge’s proposed oil pipeline tunnel beneath the Straits of Mackinac, the Michigan Supreme Court has agreed to hear our challenge to the Michigan Public Service Commission’s (MPSC) approval of the project. This is a significant victory for our client, the Bay Mills Indian Community, and a broad coalition of Tribal Nations and environmental groups working to protect the Great Lakes. The Court’s decision to grant our appeal means we’ll have the opportunity to argue that the MPSC failed to properly assess the environmental risks of the project, including the long-term threat of oil spills and the cumulative impacts of continued fossil fuel infrastructure.

Our appeal raises two issues under the Michigan Environmental Protection Act (MEPA). First, that the Michigan Court of Appeals was required to conduct an independent environmental review; and second, that the MPSC failed to consider pollution from potential oil spills when evaluating the project. This litigation is part of a broader, multi-front effort to stop Line 5, with active challenges underway in both Michigan and Wisconsin. We’re proud of the incredible work by our Midwest team and partners, and we’re ready to keep fighting to protect the Great Lakes.
