America First Legal Newsletter – September 19, 2025

We’re forging ahead with impactful work to uphold America First principles. Our efforts this week highlight our dedication and tenacity. Here’s what America First Legal has been up to:

THIS WEEK’S KEY ACCOMPLISHMENTS:

VICTORY — U.S. Department of Education Finds Loudoun County Public Schools Violated Title IX and Retaliated Against Male Students Following AFL’s Lawsuit

Just after AFL and the Founding Freedom Law Center filed a Title IX lawsuit earlier this week against Loudoun County Public Schools (LCPS) on behalf of male students who were discriminated against by LCPS, the U.S. Department of Education’s Office for Civil Rights (OCR) found LCPS violated Title IX and retaliated against these male students. OCR’s decision also came on the same day a federal judge granted emergency relief in our case. OCR has given LCPS ten days to agree to a resolution that includes rescinding its suspensions, reviewing disciplinary actions, issuing apologies, notifying families about proper Title IX procedures, and providing staff training. These steps aim to ensure future compliance with Title IX standards.

Federal Court Grants America First Legal’s Emergency Motion and Stops Loudoun County Public Schools from Suspending Boy who Objected to a Girl in the Boys’ Locker Room

Following America First Legal's federal lawsuit against LCPS for violating the federal and state constitutional and statutory rights of two male high school students, a federal judge granted AFL’s motion for emergency relief in our new lawsuit. The Court stopped LCPS from suspending one student (the other had moved from the area) who objected to a girl in the boys’ locker room pending further action on the case.

America First Legal Urges U.S. Supreme Court to Stop the Fourth Circuit’s Radical Rewrite of Title IX

AFL filed an amicus brief urging the U.S. Supreme Court to reverse a Fourth Circuit decision that redefined “sex” under Title IX to mean “gender identity.” This reinterpretation undermines protections for girls’ sports, privacy, and equal opportunity, which Title IX was originally designed to secure by recognizing biological differences. The brief cites real-world consequences, including incidents in Virginia schools where gender identity policies led to privacy violations and confusion. The ruling replaces legal clarity with ideology.

America First Legal Files Brief Supporting the Trump Administration’s Actions to Ensure Public Safety in Washington, D.C.

AFL filed an amicus brief urging a D.C. court to reject Attorney General Brian Schwalb’s lawsuit aimed at halting federal assistance in restoring public safety in Washington, D.C. The brief defends the Trump Administration’s actions, such as deploying the National Guard and supporting law enforcement, citing a sharp decline in violent crime, carjackings, burglaries, and car thefts as evidence of success. AFL criticizes Schwalb’s legal challenge as ideologically driven and harmful to public safety. The court should uphold federal efforts to protect law-abiding citizens.

America First Legal Submits Public Comments Supporting the Trump Administration’s Proposed Rule to End Race- and Sex-Based Discrimination in Federal Contracting

AFL submitted comments supporting the Department of Labor’s (DOL) proposed rule to rescind regulations implementing President Johnson’s Executive Order 11246, which  long enforced race- and sex-based hiring mandates in federal contracting through affirmative action. Johnson’s order diverged from earlier executive actions focused on nondiscrimination by actually imposing race-conscious hiring practices. AFL strongly supports DOL’s proposed rule to return to merit-based decision-making, which aligns with President Trump’s Executive Order 14173 and recent Supreme Court rulings like SFFA v. Harvard. Shutting down these affirmative action programs is necessary to uphold the Constitution’s Equal Protection Clause and eliminate discriminatory practices in federal hiring.

America First Legal Files Brief Led by U.S. Senator Mike Lee and Coalition of U.S. Senators Urging SCOTUS to Protect Federal Contractors from Hostile State Lawsuits

AFL, alongside several U.S. Senators, filed an amicus brief urging the U.S. Supreme Court to overturn a Fifth Circuit ruling that restricts federal officers’ and contractors’ ability to transfer cases to federal court. The case, Chevron v. Plaquemines Parish, centers on whether companies fulfilling federal wartime contracts during WWII can be shielded from state court lawsuits. AFL argues that the Fifth Circuit’s narrow interpretation of federal removal protections undermines Congress’s longstanding intent to shield federal agents and contractors from politically hostile state actions. They warn that weakening these protections could deter private contractors from assisting in federal law enforcement, threatening national security and the rule of law.

America First Legal Calls on U.S. Department of Justice to Investigate Washington University School of Medicine in St. Louis for Illegal Discrimination

AFL has filed a federal civil rights complaint against Washington University School of Medicine (WashU), urging the DOJ to investigate WashU’s alleged unlawful and systemic implementation of Diversity, Equity, and Inclusion (DEI) policies. AFL claims WashU prioritizes race, sex, and identity in admissions, faculty hiring, and residency programs, abandoning merit-based standards and violating multiple federal laws and Supreme Court precedent. The complaint argues that WashU uses a “holistic review process” to bypass race-based admissions bans, embedding racial preferences throughout its medical programs. AFL asserts that this DEI agenda compromises medical education by prioritizing activism over competence, ultimately harming both students and patients.

America First Legal and Founding Freedoms Law Center File Federal Lawsuit Against LCPS Seeking Emergency Relief to Stop Boys’ Suspension for Complaining About a Girl in Their Locker Room

AFL and Founding Freedom Law Center sued Loudoun County Public Schools (LCPS) this past Monday for finding two male students guilty of “sexual harassment” for objecting to a girl entering the boys’ locker room and filming boys changing. The suit alleges LCPS violated the students’ rights under the United States Constitution, the Virginia Constitution, Title IX, and the Virginia Religious Freedom Restoration Act.  While LCPS had suspended one of the boys, the girl wasn’t suspended.

AMERICA FIRST LEGAL IN THE NEWS:

Washington Examiner: “Missouri medical school faces DEI complaint: ‘More egregious than Harvard’”

“America First Legal, a nonprofit legal organization founded by President Donald Trump’s top adviser Stephen Miller, filed a sweeping civil rights complaint Monday alleging the school operates a system of ‘systemic, intentional, and ongoing’ discrimination based on race, sex, and other protected traits. The group is requesting immediate enforcement action from the DOJ’s Civil Rights Division.

‘WashU has transformed its medical school into a DEI indoctrination training camp,’ said AFL counsel Megan Redshaw in a statement. ‘This isn’t compliance with the law — it’s contempt for it. WashU is far more egregious than Harvard or UNC because its unlawful discrimination extends beyond admissions and pollutes every corner of medical education.’”
