Yesterday, the U.S. Department of Education’s Office for Civil Rights formally concluded that Loudoun County Public Schools violated Title IX and retaliated against male students.

VICTORY — U.S. Department of Education Finds Loudoun County Public Schools Violated Title IX and Retaliated Against Male Students Following AFL’s Lawsuit

WASHINGTON, D.C. – Yesterday, the U.S. Department of Education’s (DOE) Office for Civil Rights formally concluded that Loudoun County Public Schools (LCPS) violated Title IX and retaliated against male students in connection with “sexual harassment” claims. This finding came just one day after America First Legal (AFL) and the Founding Freedom Law Center (FFLC) filed a lawsuit against LCPS on behalf of these students, and on the same day, a federal judge granted AFL and FFLC’s motion for emergency relief.


DOE has given LCPS ten days to voluntarily enter a resolution agreement, which requires the school district to take the following actions:

  • Rescind the suspensions imposed on the two male students.

  • Review its findings to determine if discipline of the male students is warranted. 

  • Issue letters apologizing for LCPS’ failure to properly investigate Title IX complaints.

  • Notify students and parents that LCPS will promptly investigate Title IX complaints in a manner compliant with the requirements of Title IX.

  • Provide training to all high school and Loudoun County staff who receive or respond to reports of sexual harassment under Title IX.

“The Department of Education’s conclusion confirms what we have said all along — Loudoun County unlawfully retaliated against our clients. We look forward to defending them in Court,” said Ian Prior, Senior Counselor at America First Legal.
