AFL and FFLC have filed a federal lawsuit in the Alexandria Division of the Eastern District Court of Virginia alleging that LCPS violated our clients’ rights under the U.S. Constitution.

America First Legal and Founding Freedoms Law Center File Federal Lawsuit Against LCPS Seeking Emergency Relief to Stop Boys’ Suspension for Complaining About a Girl in Their Locker Room

WASHINGTON, D.C. – Today, Loudoun County Public Schools (LCPS) informed us that the suspension of two LCPS boys, who were recently deemed guilty of Title IX “sexual harassment” for complaining about a girl in their locker room, will be upheld, and a 10-day suspension will begin tomorrow for the student still enrolled at Stone Bridge High School. The boys and their parents are jointly represented by America First Legal (AFL) and Founding Freedoms Law Center (FFLC). In response, AFL and FFLC have filed a federal lawsuit in the Alexandria Division of the Eastern District Court of Virginia alleging that LCPS violated our clients’ rights under the United States Constitution, the Virginia Constitution, Title IX, and the Virginia Religious Freedom Restoration Act. AFL and FFLC have also filed a motion for a temporary restraining order to prevent LCPS from suspending the students and ultimately, to vindicate both students who LCPS has wrongly labeled as sexual harassers. 


“Four years ago, Loudoun County Public Schools couldn’t be bothered to open a Title IX investigation after a male student sexually assaulted a female student in a female restroom,” said Ian Prior, Senior Counselor at America First Legal. “Now, the same school system has found that two boys violated Title IX for merely questioning why a female is in a boys’ locker room while they are getting changed – a concern that any sane person in the same situation would have. The common thread through both actions by the Loudoun County School Board is its demand that all students accept radical transgender ideology or suffer severe consequences. As a result, the Loudoun County School Board and administration will now have to justify to a federal judge its knowing and intentional violation of the Constitution, federal and state laws, and common sense.” 


Victoria Cobb, President of the Founding Freedoms Law Center, remarked: “These boys must not serve one day of their suspension. I am confident our justice system will overrule the decisions made by biased, ideologically driven administrators.”


According to Seth Wolfe, father of the student being suspended tomorrow, “This is just wrong for so many reasons. My son is being removed from his school and missing class for ten days for speaking the truth and standing for what is right. LCPS is out of control, and I hope the courts intervene to stop this.”
