Laws matter. Sex
discrimination in law can perpetuate violence against women and girls,
especially when they ignore a woman’s right to consent. In India,
Section 375 of the Indian Penal Code allows a man to rape his
wife.
Rape is rape, even if you’re married.
Under Indian law,, there are
no criminal penalties for marital rape when a wife is
over 18 years old. The
failure to criminalize marital rape is also compounded by another law
which allows the court to enforce “conjugal rights” even when the wife
does not wish to live with her husband.
This must
stop.
Laws that prioritize husbands over
wives and “duty” over consent put women at increased risk of sexual
violence, with fewer means of escape. Such laws also treat women as
the property of their husbands.
