Recently, the Pennsylvania state House Environment & Natural Resources Protection Committee passed a bill that will give low-income and Black and Brown residents a critical tool that could help stop new polluting facilities like incinerators and oil refineries from getting built if their communities are already facing major sources of pollution.
Right now, Pennsylvania reviews each project individually — without considering how much pollution a community already faces.
All that dirty development in one place means that communities already struggling with pollution keep getting hit again and again.
House Bill 109 would change that. It would require the state to take a closer look at the total impact of pollution in Environmental Justice (EJ) communities before it approves new development that will pollute.

This kind of legislation is already making people’s lives better in other states, but it only made it through PA’s state house committee along party lines.
Pennsylvania’s environmental laws are meant to keep pollution in check — and that’s a good thing. But those laws were written before communities were surrounded by multiple polluting facilities like incinerators, warehouses, sewage plants, and oil refineries. Today, those facilities are piling up in low-income neighborhoods and communities of color, and the rules meant to protect Pennsylvanians haven’t caught up.
House Bill 109 would help fix that. If a company wants to build something like another incinerator in a place like Chester — a city already overwhelmed by pollution — regulators would have to look at the bigger picture. That means considering how the new project adds to the pollution the community is already dealing with, not just whether it meets the minimum legal standards.
