We have a big win in our case against the Trump administration: the DC Circuit Court of Appeals ordered the Office of Management and Budget to bring back its spending database—and they did.
The judges in our case determined that allowing OMB to hide funding decisions from the public by eliminating the apportionments database would be contrary to federal law and America’s founding ideals—so they granted CREW the win and rejected the government’s attempt to pause the case.
Here are some key excerpts from the decision:
"Appellees, for their part, have shown harm if a stay is entered. They will be deprived of information that the Founding generation—from Franklin to Jefferson to Madison to Mason—all thought vital to our Republic. "
"To grant the Executive a stay pending appeal in this separation of powers standoff would effectively cut the Congress’s purse strings.”OMB has now brought the database back. This is a huge win, as this database is a crucial tool for government transparency. Without it, the Trump administration set the stage to conceal its use of federal funds without accountability.
Now that OMB has restored the website, CREW is able to resume monitoring it for potential abuses, and inform the public when they occur.
We’ve already seen what the Trump administration has been doing behind the scenes, like ignoring a directive from Congress and refusing to fully fund an HIV prevention program that is widely credited with saving millions of lives.
This raises the question: what else is the Trump administration trying to hide?
As we explain in our new analysis [[link removed]] piece, many government databases that provided important public information have been abruptly taken down over the last 6 months, depriving the public, experts and government officials of crucial health and scientific data, criminal case files of individuals who participated in the January 6th insurrection, information about law enforcement misconduct, and resources on teen dating violence, preventing post-partum depression and much more.
CREW’s court win to restore OMB’s spending data matters—but it’s just one step. Without access to government data, the public can’t hold the powerful accountable.
