John, the United States is behind.
We’re disappointed to share this Women’s Equality Day that the Equal Rights Amendment (ERA), which ensures constitutional equality in the US, has yet to be universally recognised and implemented. This is despite the ERA meeting all requirements to be recognised as the 28th Amendment to the US Constitution and former President Biden declaring the ERA the “law of the land” in January 2025.
A lack of recognition and implementation puts women and girls at risk, denying protections and weakening legal redress for gender-based violence and discrimination.

Equality Now highlighted this lapse in our joint submission ahead of the US’s Universal Periodic Review (UPR) this year. Every 4.5 years, the UPR provides an avenue for UN Member States to highlight the United States’ failure to comply with international human rights laws. Our submission, designed to support peer nations in issuing strong, evidence-based recommendations for reform, highlighted four critical areas: child marriage, female genital mutilation, online sexual exploitation and abuse, and a lack of constitutional equality.
Our hope is that the US will accept those recommendations and take action, including by fully recognising and implementing the ERA. We will continue to share the importance of our submission, including in-person in Geneva this month, where we will speak directly with Member States to outline ongoing human rights issues in the United States.
