WASHINGTON, D.C. – America First Legal (AFL) and the State of Texas have filed a motion to intervene in a pivotal federal lawsuit in the Northern District of California. The motion seeks to stop Governor Gavin Newsom from imposing his radical electric vehicle mandate on the rest of the nation—undermining fair competition and consumer choice. Americans deserve the freedom to decide whether to purchase an EV or a gas-powered vehicle based on the merits of the vehicle in question—not the whims of biased bureaucrats in California.
California’s scheme would effectively outlaw the sale of new gas- and diesel-powered vehicles by 2035, forcing automakers to bow to Newsom’s rules. Because manufacturers typically do not produce different vehicle lineups for different states, California’s mandate would dictate the requirements for all cars sold throughout the entire United States. That means fewer choices for families, skyrocketing costs, and an America remade in California’s image.
Congress and President Trump already acted to rein in this abuse of power by rescinding the federal waivers that allowed California to forge its own path. But the state immediately turned to the courts, insisting it is above the law and free to ignore federal law and force its preferences on Texas—and all Americans. AFL, alongside the Texas Attorney General’s Office, is stepping in to ensure that no single state can weaponize the courts to impose its ideology on the rest of the country. The motion to intervene asks the court to allow Texas to become a party to the case to defend the interests of Texas and its citizens and to fight California’s backdoor attempt to force an EV mandate on the whole country.
