Twenty-eight businesses and trade associations, including 12 ASBC member signees, have already taken a stand by signing an amicus brief ([link removed]) to protect the rights of employers to freely continue their critical and lawful diversity, equity and inclusion work. Standing alongside them are 18 states and numerous civil society organizations to defend fair workplaces and free speech.
On September 24, the law firm Davis Wright Tremaine will file an amicus brief in the Seventh Circuit Court of Appeals in support of a legal challenge filed by Chicago Women in Trade against a January 21 Executive Order ([link removed]) (EO). This EO seeks to prevent private companies from engaging in programs that advance diversity, equity and inclusion in their workplaces. By sharing the perspectives of private employers, the brief will:
* Educate the court on the nature of DEI programs, why they exist, and how they are carefully calibrated to comply with the law.
* Illuminate the risk employers face by moving away from DEI programs and the burden on their First Amendment rights from the self-censorship the Executive Order encourages.
