Powered by People Wins Restraining Order Against Ken Paxton, Whose “Entire Course of Conduct” Singles Out Beto and His Organization For “Targeted Enforcement Based Solely On” Their Protected Constitutional Activity

District Court Judge bars Paxton from initiating, filing, or prosecuting proceedings against Powered by People to strip its business license, while declaring that the Attorney General’s improper action is “part of a larger course of attempting to use the legal system to impinge on” the “constitutionally protected activity” of Beto and his organization.

EL PASO, TX — Powered by People defeated Ken Paxton in court yesterday, winning a restraining order against the corrupt, lying, impeached, and twice indicted Attorney General. The 41st Judicial District Court ruled that Paxton and his office are restrained and enjoined from initiating, filing, or prosecuting “quo warranto” proceedings against Powered by People – which go after the group’s business license – while adding that the organization is “currently suffering irreparable constitutional harm” due to the Attorney General’s “improper proceedings.”

The court also declared that Paxton’s nonstop attacks against Beto and Powered by People are “part of a larger course of attempting to use the legal system to impinge” on their “constitutionally protected activity.”

The scathing rebuke against Paxton found that his “entire course of conduct” has been carried out to single out Beto and Powered by People for “targeted enforcement based solely on” their protected constitutional activity. The Judge also states that Paxton admitted that “he did not have details to support his allegations” against Beto and Powered by People in the first place. Additionally, the court found that the State’s actions had amounted to an outright restraint on Powered by People’s protected speech as well as “retaliatory and chilling court processes.”

“We took the fight directly to Ken Paxton, and we won,” said Powered by People Founder Beto O’Rourke. “We will never stop speaking out, organizing, and fighting for our fellow Texans.”

Yesterday’s ruling also addressed Paxton’s “improper proceedings” in Tarrant County, which the Judge declared “an improper venue” for a quo warranto action.

The restraining order took effect immediately yesterday afternoon.
