Secretary of Commerce Howard Lutnick appears to have violated the Hatch Act live on Fox Business.
On July 31st, Lutnick appeared on Fox Business, standing outside the White House. He told Larry Kudlow, “… the people in New York had better get off their butts and get out there and vote and make sure this communist doesn’t run New York City,” urging voters to defeat New York City mayoral candidate Zohran Mamdani while speaking in his official capacity as secretary.
Under the Hatch Act, executive branch employees are prohibited from using their official authority or influence to interfere or affect the result of an election.
The American people should have confidence that their commerce secretary is looking after their interests—not misusing his government position for partisan political gain.
That’s why CREW filed a Hatch Act complaint asking the Office of Special Counsel to investigate Lutnick’s behavior and take appropriate steps to enforce the law.

Lutnick’s apparent violation of the Hatch Act is part of the Trump administration’s pattern of indifference to rules and laws meant to ensure those in government act ethically.
During Trump’s first term, CREW’s Hatch Act complaints led to the Office of Special Counsel finding a significant number of Trump administration officials had violated the Hatch Act.
This included former senior counselor Kellyanne Conway, whom OSC recommended be removed from her position due to her numerous Hatch Act violations.
CREW also brought a complaint against Biden administration official, Jen Psaki. OSC also found she violated the Hatch Act.
Top officials, especially Cabinet secretaries like Lutnick, set the standard for the rest of the federal workforce—which is why it’s imperative that the OSC investigate his behavior.
