Emergency rulemaking related to SSB 5393 Closing the Rainier school by June 30, 2027

You have been identified as a stakeholder for rulemaking activities related to the DSHS Behavioral Health and Habilitation Administration’s work on residential habilitation centers. Emergency rulemaking is necessitated by the legislature’s passage of SSB 5393, Closing the Rainier school by June 30, 2027. This legislation directs that DSHS will not permit “any new long-term admissions” to Rainier School as of July 27, 2025, and no new admissions as of June 30, 2027, except those clients who have return rights as defined in the bill.

*WSR 25-15-131* [ [link removed] ] serves as the notice of emergency rules and *SHS-5098.3 [ [link removed] ]* is the text of the emergency rules that has gone into effect.

These emergency rules are necessary to set standard definitions and implement the legislation on time. The emergency rule is effective July 27, 2025.

In conjunction with the emergency rules, we are also beginning the process of permanent rulemaking on the same topic. *WSR 25-15-137 [ [link removed] ]* serves as notice of permanent rulemaking efforts. As the permanent rulemaking moves forward you will continue to receive updates and opportunities for feedback.
