Did you hear the news? Trump’s latest judicial nominee, Emil Bove, was confirmed and appointed to the U.S. Court of Appeals for the 3rd Circuit, which has jurisdiction in Pennsylvania.

As I told WHYY, my first thought when I heard the news was that I hope Bove never gets to hear a voting rights case that’s going to impact Pennsylvania. I think he was put in place specifically to make decisions about our 2026 and 2028 elections here in the commonwealth. In fact, I believe this is all strategic – that he was put in place to carry out what it is he’s supposed to do.

Here’s some background: the legacy of this highly controversial appointment of Bove for a lifetime to the U.S. 3rd Circuit Court of Appeals includes; as deputy attorney general in the Department of Justice, Bove firing career federal prosecutors who convicted Jan. 6 rioters, ordering prosecutors to drop the corruption case against NY Mayor Eric Adams, and a whistleblower told Congress that Bove himself told Department of Justice officials that they might have to disobey court orders.

This appointment has shifted the political balance of the U.S. Court of Appeals, giving Republicans the majority. And, it gets worse. 

After Joe Biden won the 2020 election, the Trump campaign’s challenge was appealed up to the 3rd Circuit, and the court responded that Trump’s claims had “no merit.” But with a GOP majority on the court, we may see a very different outcome during the next presidential election. With PA being a key battleground state, this could have major implications for the future of our nation. 

This appointment could significantly affect our court system's ability to serve as a check and balance on the Trump regime. With this news, it becomes even more important that we stand against MAGA’s anti-retention campaign targeting our three democratically elected PA Supreme Court justices this November.
