We are only 3 months away from the November elections in PA, and to demonstrate just how critical the state Supreme Court retention elections are, we wanted to highlight some recent decisions made by the PA Supreme Court that impact our everyday lives.

Take a look at a few examples:
Education (William Penn SD v. PA Dept. of Education): A landmark decision ruling that PA’s school funding system is unconstitutional, alleging that the state failed to adequately and equitably fund public education.Gerrymandering (League of Women Voters v. Commonwealth): Congressional maps in PA were struck down as unconstitutional partisan gerrymander under the state constitution, and the state Supreme Court ordered the General Assembly to submit a new redistricting plan.Voting Rights (Genser v. Butler County Board of Elections): After two voters had their provisional ballots rejected during the 2024 PA primary election, the PA Supreme Court ruled that voters whose mail ballots are rejected may cast valid provisional ballots.Abortion Rights (Allegheny Reproductive Health Ctr v. DHS): The PA Supreme Court ruled that the state statute that bans abortion coverage through the Medicaid program violated the Equal Rights Amendment and equal protection provisions of the PA state Constitution.Environmental Protection (Shirley v. Legislative Reference Bureau): It was ruled that nonprofits can intervene to defend environmental regulations under the ERA.

Here’s the deal: Republicans are running an anti-retention campaign against three Democratically elected justices on the PA Supreme Court. They see these retention elections as their best chance to reverse the Democratic majority on the PA Supreme Court. If they are successful, we can expect to see very different judicial decisions.
