*NOTICE OF RULEMAKING*

Notice is hereby given that the Superintendent of Insurance will hold a public hearing in a hybrid format on August 26, 2025 at 11:00 a.m. in the Central Conference Room of the Department of Professional and Financial Regulation building, 76 Northern Avenue, Gardiner, Maine to receive comments concerning proposed amendments to Rule Chapter 210 – Standards for Pharmacy Benefits Managers. The link to register for the hybrid meeting will be posted on the Bureau’s website on the Public Event Notices [ [link removed] ] page.

The rule is amended in response to changes in law made by Public Law 2025, Chapter 291 to prohibit spread pricing by pharmacy benefits managers. A copy of the proposed amendments is at [link removed] [ [link removed] ]

The amendments are proposed in accordance with 24-A M.R.S. §§ 212, 4348(8), and 4349(5).

Primary sources of information relied upon by the Bureau of Insurance in developing the proposed amendments include P.L. 2025, Ch.  291, and Bureau staff’s professional judgment.  

All interested persons are invited to provide oral comments at the hearing or to submit written comments.  Written comments must be received no later than September 9, 2025 at 4:00 p.m. and should be addressed to: Karma Lombard, Maine Bureau of Insurance, 34 State House Station, Augusta, Maine 04333, or [email protected].  A copy of the statement of impact on small business may be obtained from Ms. Lombard.
