Earlier this year, the Office of Management and Budget directed federal agencies to temporarily freeze nearly $3 trillion in congressionally approved federal funding to further the Trump administration’s policy goals.
But the Constitution grants Congress the power to assign taxpayer money, and OMB does not have the legal authority to unilaterally freeze funding.
That’s why 22 states, the governor of Kentucky and the District of Columbia sued the administration, alleging OMB violated the Constitution and the Administrative Procedure Act.
To help make the case, CREW just filed an amicus brief on behalf of over a dozen former OMB officials who served under both Republican and Democratic presidents explaining OMB’s authority and urging the court to block this power grab.

That’s why the Trump administration’s order to freeze trillions in federal funding without Congressional approval is executive overreach and cannot be allowed to go unanswered.
Instead of using legal avenues to implement his policies, like both Republican and Democratic administrations have done for decades, Trump’s OMB took unilateral action—threatening both Congress’s authority and the essential services Americans depend on.
Our system of checks and balances depends on the executive branch respecting the authority of Congress, and in this case OMB has not.
That’s why a lower court issued an order to prevent the administration from reissuing or otherwise implementing the funding freeze—and we believe the appeals court should affirm the lower court’s ruling to ensure that the funds Congress appropriated can reach the programs people rely on.
