(LANSING, MICH) The Michigan Department of Insurance and Financial Services (DIFS) has issued Summary Suspensions [ [link removed] ] against Peak Title of Michigan Inc. and Peak Title Agency Co., two Michigan based title insurance agencies. The agencies are alleged to have violated provisions of the Michigan Insurance Code by engaging in practices that pose a risk of financial loss and serious negative consequences for consumers.
"Consumers should feel confident that their title agency is compliant with the law, maintains proper safeguards, and protects customers' funds. After conducting a thorough investigation, it was clear that immediate action against Peak Title of Michigan Inc. and Peak Title Agency Co. was necessary to ensure consumers are protected," said* DIFS Director Fox. *"If you believe you have been affected, please call 877-999-6442 from Monday to Friday between 8 a.m. and 5 p.m., or visit the department's website [ [link removed] ] and complete a complaint form [ [link removed] ]."
DIFS initiated the suspensions after receiving reports that consumers who had deposited funds into escrow accounts with these title agencies received noticed that taxes, utilities, and liens had not been paid, which can lead to foreclosure or other claims against a property’s title. Peak Title of Michigan Inc. and Peak Title Agency Co have 30 days from the service of the suspensions to contest the suspensions by requesting an administrative hearing.
When working with a mortgage company or title agency, it is important to verify that the entity is in good standing. You can do so by taking the following steps:
* Visit the entity’s website and verify that it is secure. Be cautious if the company initiated contact with you.
* Check the National Nationwide Multistate Licensing System Consumer Access website [ [link removed] ] to confirm the company and any individual Mortgage Loan Originators are licensed or registered and in good standing.
* Verify that the title agency holds an active license by using DIFS’ Agency Locator tool [ [link removed] ].
* Once you are working with a title agency or mortgage company, be sure to monitor property or tax payments as they come due to confirm that funds have been withdrawn from the correct account. If there any issues arise, call your mortgage company or title agency immediately.
* Additionally, check with your county registrar to make sure all documents associated with a property transaction were properly filed.
