This year has been hard – I know we’ve all felt that. Only six months into this new administration, and we’re watching Trump and his gun industry goons dismantle our life-saving work. They are working to roll back federal progress and are strategically attacking our work in the courts. They want to weaponize the Constitution to undo critical legal protections, but we at Brady are working to hold the line, and we are winning.

Brady’s legal experts are celebrating three major wins after judges in the Fifth and Fourth Circuit Courts of Appeals upheld life-saving laws. The attacks were under the guise of constitutionality, pushing for an extremist interpretation of the Second Amendment. But we know our legal efforts are constitutional, and we’ll keep tearing apart their paper-thin arguments.

In November, United States v. Allam placed the Gun Free School Zones Act under the gun lobby’s guillotine. This regulation was passed in the wake of the Parkland massacre to finally protect our kids from gun violence in schools, because every day, kids fear they’ll go to school and never come home. In short, the Gun Free School Zones Act saves students’ lives.

Brady and Team ENOUGH filed an amicus brief with gun violence prevention partners, testifying to the crucial role of Gun Free School Zones for preventing gun violence in school. While we fought to restore the feeling of safety for students who’ve witnessed school shootings, the gun lobby supported the criminal defendant contesting the law and urged the court to strike it down.

In December, two cases brought against the ATF challenged the federal restriction on selling firearms to persons under 21. Plaintiffs in Brown v. ATF and McCoy v. ATF argued that restrictions on Federal Firearm Licenses infringed on their Second Amendment rights. Brady’s amicus brief explained that the regulation is consistent with the Constitution and does not violate the Second Amendment.
At Brady, we know that students’ ease of access to guns heightens the risk of reckless violence in schools and at home. We’ll keep working to prevent senseless violence at the hands of youth, whose brains are still developing, and keep kids away from guns.

In June, the Fifth Circuit Court of Appeals – a very conservative court – sided with Brady’s position, affirming the constitutionality of the Gun Free School Zones Act. It’s simple: the law is constitutional, and it protects kids. The Fourth Circuit Court of Appeals upheld the restrictions on federally licensed dealers selling to persons under 21. These are critical wins in our fight against the gun lobby, and we’re grateful for the lives that will be saved because the courts sided with us. But we know the fight is far from over.
