Categorical Exclusion Determination, Town of Pavillion, WY, Pavillion No. 9 Project
The Department of Environmental Quality/Water Quality Division (DEQ) has conducted a review of the proposed Pavillion Well No. 9 project in accordance with EPA and State of Wyoming procedures for implementing the State Environmental Review Process. DEQ has determined that this project is eligible for a categorical exclusion. Accordingly, DEQ is exempting the project from further substantive environmental review requirements under the State Environmental Review Process. Neither an Environmental Assessment/Finding of No Significant Impact nor an Environmental Impact Statement/Record of Decision will be required for the proposed action. The following is a brief description of the situation and the proposed action, and a brief statement of how the action meets the criteria for a categorical exclusion.
The Pavillion No. 9 Well project will include the installation of the submersible pump and motor in the recently drilled No. 9 well. This will also include the installation of the No. 9 well pump house and the connection of this well to the existing Pavillion water supply system. Well No. 9 will produce higher quality water for the town of Pavillion and provide an additional water source should the other supply wells fail. Based on current cost estimates, the Town of Pavillion plans to borrow $118,630.00 from the Wyoming Drinking Water State Revolving Loan Fund administered by the Wyoming Office of State Lands and Investments. Current user fees will repay the loan, but the town does not anticipate the need to increase the user fees. The loan terms will be 1.5% interest rate and 30 years.
The Town of Pavillion is aware of and accepts the fact that they will be responsible for any required mitigative actions associated with and including storm water runoff, erosion control, archeological/historic artifacts, and air quality concerns. These will be part of the standard State Revolving Funds Program contract conditions. During construction, there will be slight disturbance to the area in the form of noise and earthwork. There will be short-term increases in noise, air-particulate levels, and traffic in the immediate vicinity of the construction activities. Dust control measures will be required if the dust becomes a nuisance, and disturbed vegetation will be re-established in accordance with the local land-use type and as requested by the Landowner.
DEQ is granting an exclusion because the Well No. 9 project will be addressing system deficiencies, such as aging wells and water quality. This project will be completely constructed in previously disturbed ground, specifically ground disturbed the operations of the Midvale Irrigation District (storage yard), the drilling and completion of Pavillion’s No. 8 well and the installation of two municipal water lines that carry water from the wells up to the storage tanks and from the storage tanks out into the Pavillion distribution system. DEQ has determined that exempting the proposed project from further review under the State Environmental Review Process will not result in adverse impacts to the population or the area of Pavillion, Fremont County, Wyoming.
